We are recruiting a dynamic, enthusiastic Commercial Counsel to join our team based in the West Midlands. This vital role will be responsible for commercial law support to Tarmac businesses, leading on contract-based disputes and also customer supply contracts as well as supporting on M&A projects. You will support the business in legal compliance and risk management as well as advising on health and safety litigation and major incident response.

This is a hybrid working role based out of our Tarmac Solihull office so it is easily accessible from Birmingham, Solihull, Coventry, Tamworth and across the West Midlands and East Midlands.

Main Responsibilities

Reporting to the Senior Legal Manager, the role of Commercial Counsel will be responsible for providing strategic advice on commercial contracts throughout the Tarmac businesses and leading on contract disputes – by giving strategic advice and managing all aspects of disputes including with panel law firms. You will also work closely with key stakeholders to structure projects in the optimal way for different transactions (eg: via joint ventures, strategic collaboration agreements or alliances, or strategic subcontracts), and you will build relationships throughout the business by tailoring and delivering legal training.

As Commercial Counsel you will also be responsible for

• Supporting on the legal response to Health and Safety incidents and HSE disputes
• Training the business (identifying training needs, writing and delivering training programmes with the rest of the commercial legal team)
• Assisting the wider commercial legal team with commercial and corporate legal support
• Supporting the legal entity rationalisation project across the Tarmac group of companies
• Managing and coordinating project-specific subcontracts
• Assisting the wider commercial legal team with commercial and corporate legal support
• Supporting Procurement function as required
• Proactive risk management for the Tarmac businesses
• Responsibility for creation and maintenance of precedents and toolkits
• Supporting on external panel and costs management
• Providing legal updates and horizon scanning to team and wider business

The Ideal Candidate

The ideal candidate for the role of Commercial Counsel will be a Qualified Solicitor, Barrister or Legal Executive with strong relevant commercial and corporate legal experience in private practice and in-house (at least 3 years PQE).

Suitable candidates for the role of Commercial Counsel will also possess:

• Ability to identify training needs within the business and to write and deliver training programmes alongside commercial legal team colleagues
• Experience of advising key stakeholders at all levels of a business
• Proven skills in creating and maintaining precedents and toolkits
• Proactive risk management skills
• Skills to assist the wider commercial legal team with commercial and corporate legal support
• Superb communication skills
• Ability to engage, support and influence both with the wider team and stakeholders at all levels
